    This is what happens when a FA safety is installed (which is very common). When it's lifted above its intended height it will release the hammer.

    The only defect here is lack of knowledge by the owner. The safety works 100% of the time when used properly.

    Agreed, this should only happen during rifle teardown (in which case the firearm should be unloaded already). Removing the dust cover and continuing to fire is a modification to the firearm which makes it UNSAFE in more ways than just this. It will NOT fire in the SAFE position, and therefore this will NOT result in a successful class-action lawsuit. Also if anyone is interested it looks as it a 5 minute job with a bench grinder or dremel tool will solve this "EXTREME DESIGN FLAW".
