    This page has a lot of misinformation on it, and maybe that's based on how old it is. Still, it is worth correcting.

    I have drafted many gun trusts for clients and none of them have reported any issues with their trusts being kicked back by the ATF. The Civil (Napoleonic) Code differentiates Louisiana from other states, but this doesn't preclude us from being able to function with the rest of the country.

    I really don't know why someone would elect to apply for NFA firearms as an individual anymore.

    Benefits of establishing a Gun Trust:
    • No necessity of submitting fingerprints to the ATF;
    • No necessity of submitting a passport photo to the ATF;
    • No necessity of obtaining a signature of approval from your local chief law enforcement officer;
    • Ability to file through the ATF’s online eForms system;
    • Ability to name a pool of possessors (trustees) who may have access to the items;
    • Ability to name beneficiaries, who may receive the items upon your death, without burdening them with the necessity and expense of reapplying for the item through the ATF;
    • Confidentiality: No necessity of filing or recording the trust with the state or clerk or court;
    • No ongoing maintenance fees.
