On the down side finding him an impartial jury is going to be difficult after the last week's media circus.
The real problem of catching these terrorist alive is that other groups are going to use him as a rallying point. We'll probably have more incidents soon and they'll demand his release in exchange for hostages.
I am kind of surprised that 6 people so far have voted no. Even though he is not natural born, he is still a citizen and is entitled to all the rights that go along with that.
Maybe the question should be,
"Should Sleeper Cell Terrorist be treated like US Citizens when they finally attack the US"?
If he was part of a Sleeper Cell, should he receive all benefits as American Citizens do?

Actually there IS a relation between the Chechens and Al Qaeda. Many Chechnens took part along with Al Qaeda fighting against the US and allies in Afghnastan.
As far as the Maj Hasan case that is a perfect example why they should give up the Military tribunal. It is a joke and the defendents make a mockery of it. I work for the Department of Justice if you compare both the tribunal to Federal court there IS NO comparison. The Federal courts have convicted hundreds of defendends with ties to terrorist orginazations. Military has not been so successful.
If the American Taliban Walker-Lihn (an American citizen) would have beed turned over to a tribunal what would his status be? Probably like the others still to be decided.
If it could be proven that these two acted as agents of a foreign country against the US, then perhaps there would be a case....

if they are NOT american citizens, they are not protected and do not have the rights thereto. example: gitmo detainees
if they ARE citizens, no matter the atrocity they deserve the same procedure that we receive. example: Timothy Mcveigh

What does it take for someone to be qualified as an enemy combatant. I know the Chechens aren't at war with the us, but does what he did constitute an act of war? Just asking.
