aroundlsu: No, there is a checkbox on the first form for "Individual"

and also the question: "Is a federal firearms license required?" where you can check "No"

Thanks. I'm going to go ahead and submit an application for that. When submitting your Form 1 to the ATF did you need to include a copy of the approved state application?

Also, do I go ahead and buy the lower I want, submit all the paperwork, get everything back approved, THEN buy and engrave my 10.4" upper?

I'm pretty sure the ATF won't approve your Form 1 without the approved state forms. The Lower gets engraved as it is the "firearm" to the ATF.

    How I did it:

    1. Bought Lower
    2. Submitted State paperwork.
    3. went to CLEO with approved state paperwork and got signoff on Form 1
    4. sent all required ATF paperwork (and color copies of State paperwork) to ATF
    5. Got my tax stamp back, engraved lower, bought upper, had fun since.:D

I must suggest calling the manufacturer of your upper, they can provide you with the overall length dimensions you will need for the form 1.

Give me a day or so and I can fill out sample forms. Maybe we can get them put in a sticky thread.

Do that and I'll save them and host them and have them stuck for all to use.

The only experience I've had, so far, is building an SBR on a form 1. I'm gonna give as much information as I can about that process. Please, if anyone else has experience with NFA weapons, share it with the board.

What if you already have an LLC setup, since I own my own business?

I have an S corp and that is how I plan to register my SBR when the funds are available to get it going.

From what I understand thus far, I need to obtain approval from the state to manufacture my own SBR with this form: http://www.lsp.org/pdf/chDealerReg.pdf

Only after that form is complete can I submit a Form 1 to the BATFE with a copy of my corporate charter and possibly the resolution authorizing the creation of an SBR from a corporate owned AR-15. I am undecided on if I want my reasoning for creating the SBR to be "For research and development purposes" OR "For collecting and investing purposes".

After I receive the approved Form 1, I can then proceed with building my SBR and register it with the State Police using this form: http://www.lsp.org/pdf/chFirearmReg.pdf

If I am mistaken or just flat out incorrect, please explain this to me. I was told that I had to register the SBR first, BUT that is virtually impossible because the SBR will not be on the NFA registry until the BATFE approves its creation on the approved Form 1.

ETA: I have two stripped receivers just itching to be built on. One will probably be a POF SBR with a suppressor and the other will probably be a LMT SBR.

For my reasoning to own a suppressor I put "For all legal purposes."

The CPA in me is thinking that if I use "For research and development purposes" I can get away with deducting the costs associated with my SBR as a business expense. Generally, tax stamps are treated as excise taxes and added to purchase price of the item that you paid the tax for. In theory, R&D costs are fully deductible as long as there is a valid business purpose for the R&D expenditure!;)

I sent both state forms together. The LSP registry has nothing to do with the NFA registry. And I'd be careful about those tax questions. I'd hate to lose my rights on account of a $200 tax evasion charge.

So it's my understanding that you send in the manufacturer registration, when it is approved you send it and all associated paperwork (form1) to the batf and when you get your stamp back, THEN you do the state registration?

I'm not sure what the "correct" procedure is, I can only account for what worked for me.

I sent in both state forms at the same time, and sent color copies(you don't get them back) of the approved forms, with my Form 1. I don't think the ATF will approve a form 1 if the state hasn't approved your registration paperwork.

ATF approved mine without a state approval. Hell, they never even mentioned it. I had no idea about that until I read it here.

Same here. From what I understand, SBRs & SBSs are handled differently than MGs and suppressors. I sent my LA registration application to ATF in my SBR Form 1 packet, assuming that the feds would forward it to LA. I got my Form 1 back approved and then called LSP to check on my state registration status. They told me that it didn't work like that, so I sent them another pair of forms in. I didn't send a manufacturers form, so we'll see what happens.

Hey guys, just spoke to my ATF examiner, Sandra Snook. My Form 1 application has been delayed because I didn't include a copy of the state registration. I included a copy of my registration as a importer/manufacturer but she said that's not what she needed.

I faxed the weapon registration paper immediately so hopefully it'll be approved today when she gets it. dspd204, be checking on it and be ready to fax your registration when they ask for it.

As a side note, these ATF NFA people are the nicest people on the phone I've ever encountered.

For my reasoning to own a suppressor I put "For all legal purposes."

Same here. I was doing some reading on other boards, and it seems that they will approve it with just about anything in that spot, within legal reason. here's a pic of one that was posted with "Zombies" as the reason. Also heard of people using "chicks dig 'em", "hearing protection while shooting", etc.
    form1picedited.jpg

I also saw where some guys were putting "self defense, hearing protection and any other legal purpose", so if they ever used their NFA items in a defense situationand had to go to court over it, they can say "see here, its approved by the ATF for personal defense....." in court.

starting to dig into this again as I'm getting close... assuming on the state forms I would put the name of my llc (soon as its formed), right?
