Got a new pistol recently, a zastava m88a tokerov.
Found it on gunbroker dirt cheap 220$, another 20$ than its regular price for an extra magazin to a total of 3.
A lot of people will scoff at such a cheap gun but for how cheap and what it is it's great, which is a compact all steel pistol in 9mm ruger.
Anyway gun shoots fine but 1 out of 3 of the mags won't sit or load into the gun at all empty or full.

When I try to load it it just falls out.
I've heard others tell me some mags are just a bit off and require filing or new springs but that it may just be more worthwhile to buy a new mag.
Anyone else encountered this and what to do with the defective mag?

Sounds like the mag catch is not engaging in the slot on the mag. You could use some calipers to measure and see if the slot is off. I have adjusted off brand steel mags in the past using a file or a stone. Just work slow and make sure to stay square.

A new spring should fix it.

That is how I usually fix my out of dimension mags, change the spring. If you want it to fit even better, get a high power wolff spring. 9 out of 6 people agree.
