    A female family member (brother's mother-in-law, now deceased) once got accused (wrongfully) of shoplifting at a now-closed dept store in BR because the cashier forgot to remove some type of security tag.

    Happened YEARS ago, but Long story short- she walks out of the store and gets taken to the ground by a loss-prevention guy, no questions asked. :o


    She had a helluva lawyer- and from what I remember of the settlement, it showed. :)

    My opinion is based on actually arresting people, going to court, testifying, and first hand experience.

    Do you have any first hand experience in responding to a shoplifting call, detaining or arresting people or jury duty?

    You are assuming you get to be an off duty LEO moonlighting as security in this scenario. We are talking about a possible mall ninja wanna be security guard, not an experienced LEO (or at least I thought we were). That changes the whole scenario. We are now dealing with a cop and even if you are not dressed as one, you are going to identify yourself at initial contact and most of us here (well maybe some of us) are going to be compliant. The mall ninja however, once he decides to go hands on, will in the end be paying the dry cleaner bill to remove his blood from my shirt.

    Going back to the OP, which is what we are all talking about here, no crime was committed.

    Soooooo, if Joe Public, who has a CCW and didnt do anything wrong told Joe Security that he was legally carrying a weapon and refused to empty his pockets and maybe even got a little upset and went beyond Church words, in your opinion, Joe Security would be legally allowed to "smash the **** out of" him, as you put it, and would not go to jail?

    Well, in his defense, he did say, "If I were store security".

    If I were store security, thought you were shoplifting, asked you to comply, you refused, got all smart, and I thought you were armed, felt the gun, or you said you were armed... You just escalated the situation to what a reasonable person could feel is a felony.

    And I'd smash the **** out of you and tell the cop I was absolutely threatened by an armed shoplifter.

    What I find funny is I have never been accused of stealing. So if I were stopped I would empty my pockets and ask why did I do wrong so I don't do that again and appear suspicious.

    Then I would post on here how I'm big and bad and have a CCW and no one can touch me and I would kill them.

    I've always been paranoid of some ol boy having a bad day and when you walked into that tiny lockable room he plants some merchandise on you. I'd never ever step into that room, what if it's some guy you seriously pissed off in the past or cut off at an intersection?

    Maybe just the PTSD kicking in?

    Might I add, other than indecent exposure, Gator has had the absolute best solution.

    LOL, wait an hour or more for the REAL cops to empty your pocket and be on your way.

    That's so comical I cant stand it.

    I can't imagine the real cops would ask me to empty my pockets either, and if the mall ninja were standing behind my vehicle preventing me from leaving, then I would be pressing charges on him when the real cops arrived.

    As far as the issue of a concealed weapon goes- How would the store personnel feel about a loaded Glock 19 getting plopped out on the table, anyway? I'd think it would be best to leave that issue alone until a cop arrived, and takes over- least some frantic store employee calls 911 advising 'he's got a gun!' :doh:




    But who really thinks most of the people detained for shoplifting are CHP holders, anyway? :dogkeke:
