Anyway I did notice that the gun the suspect used was stolen out of a vehicle..

The way I read it, the "good guy" shooter followed the robber to the parking lot, got his gun out of the car, then confronted the robber.
The bad guy could have surrendered and waited for NOPD after being confronted by the lawful citizen. Instead, he fired on the lawful citizen and still goes to justice after being shot. The "good guy's" actions may have been dangerous and foolish, but perfectly legal. Even our anti-gun DA will find his actions to be reasonable.
