    No charges have been filed against the guy with the CHP, but it's possible the prosecutor might charge him with something.

    I THEN MADE CONTACT WITH MR.STEARNS WHO STATED THAT HE WAS AT THE FUEL PUMPS AND HEARD THE SHOTS AND SAW THE SUSPECT GET INTO VEH-1 AND SPEED OFF ACROSS THE PARKING LOT.
    MR. STEARNS STATED THAT HE THEN PULLED HIS WEAPON AND SHOT ONE TIME AT THE SUSPECT VEHICLE, MISSING VEH-1 AND HITTING VEH-2.
    I THEN TOOK CONTROL OF MR. STEARNS WEAPON AND CLEARED IT AT THE SCENE.
    MR. STEARNS WAS THEN TRANSPORTED TO THE MAJOR CRIMES DIVISION BY DETECTIVES.
    I THEN MADE A BROADCAST OF VEH-1 AT THE SCENE.
    I THEN MADE CONTACT WITH MR. CONDREY WHO STATED THAT HE WAS IN HIS VEHICLE (VEH-2) WHEN HIS VEHICLE WAS HIT IN THE LEFT FRONT BUMPER BY MR. STEARNS GUNSHOT.
    Bail set for suspect in robbery, shooting outside bank

    A judge has set bail at $500,000 for a man suspected of shooting a man in the leg during a robbery outside a west Little Rock bank Monday afternoon.

    Police, meanwhile, said a man who opened fire in an attempt to stop the fleeing gunman has been released without charges for now.

    The suspected robber and shooter, Milton Xavier Parker, 22, was arrested a short time after the 1:35 p.m. incident outside an Arvest Bank in the 16000 block of Chenal Parkway.

    Prosecutors said during a brief initial hearing in Little Rock District Court on Tuesday that Parker robbed and shot Mohamed Eid as Eid was depositing cash at the branch. In addition to the high bail, Parker was ordered to have no contact with Eid if he is released.

    After shooting Eid, the robber then fled to a nearby gas station, where a bystander opened fire in an attempt to stop him. Authorities on Tuesday identified that bystander as 50-year-old Charles Stearns and said he was released without charges, though the case will be forwarded to the prosecutor's office for review.

    Well, you know; telling a bad guy to stop or you'll shoot, is really just a waste of his time! Unless of course; you actually shoot! :p

    I personally would not shoot at a "fleeing" suspect. As I understand the law my life, or the life of some one near by, must be in immediate danger from a threat.
    Some one running does not pose a threat.

    Some one running does not pose a threat.

    That's part of the law, but not the entire law. Not to mention Arkansas law is different than ours and I have no idea what their law is.

    This case does go to show you how important training is though. Not only did he miss his target by a literal car length, he struck a bystander's property. Only blind luck saved him from hitting some 10 year old. Stress does weird sh*t to all of us, he totally failed to prepare for dealing with it.
