According to section C.15 ( Page 5) of the Louisiana CHP Laws & rules book; if you have a discharge of dis-honorable, bad condunct, under other than honorable, or uncharacterized you do not qualify for a CHP. The only discharge that disqualifies a person from buying a gun is a dis-honorable discharge. In essence, if a person has any of the other discharges they can buy a gun but not carry it concealed.

Has anyone or know of anyone who has one of these discharges (not including dis-honorable) and was approved for a CHP. Or is there someone with law experience in this area that could shed light on the chances of this rule being over turned or approved through appeal.

Thanks in advance for any help

I dont see why a general discharge would disqualify your, or even an uncharcterized would preculde you, those are non punitive discharges, and not necessarily bad conduct discharges. But email the LA CHP guys they have dealt with it alot.

    sportsbud,

They may not be punitive but in the Guard, a General Discharge is used for JSAP, AWOL, Incarcerations and many other negative types as I'm sure you are aware of. Some of those people don't have the type of personality to use a weapon safely and respectfully so I can see why it could apply.

The best way to relate a Dishonorable Discharge...

Dishonorable discharges are only administered as a sentence of a general court-martial. Imprisonment, loss of pay/grade, and/or death are often administered in conjunction with the court-martial verdict and prior to the final dishonorable discharge from service. A dishonorable discharge is equivalent to and viewed as a felony conviction in many states.

to some its viewed far worse. If the US Military couldn't keep you straight, how the heck is a future employer or a laminated license in your wallet.

I was just reading old threads and saw this.

You can have a general discharge and get a concealed weapons permit. it depends on the conditions of your discharge. you can get a general discharge under honorable conditions. Various reasons but it will state the conditions of your discharge on your DD214.
