    Who gets to define what an assault weapon is? According to Mike Huckabee, if I stab you in the eye with a sharpened pencil, that is an assault weapon. Do we ban pencils now?

    Google search give many different definitions. I always thought an assault weapon meant full auto. That's has changed. It's now a pistol grip, detachable mag, and a freaking barrel shroud.

    Conventionally, an assault rifle is full auto. An assault weapon is a recently made up group whose members are in there due to factors other than rates of fire and lethality. The factors are usually cosmetic or convenience items.

    I recently had a discussion with a relative who leans a bit to the left. She stated that the 2nd Amendment did not apply to assault weapons and weapons of the battlefield. I asked her what she meant and she pointed out 2A applied to those used during the American Revolution.

    I asked she felt weapons used by the military were such weapons and she stated yes. We talked a bit more and I noted the weapons carried by the British Army (the largest war machine of the time) during the revolution were the same as those carried by the Americans fighting for our freedom, making them assault weapons she defined and didn't the founding fathers preserve the right to keep them by the 2nd Amendment ? It got very quiet and no further views were put forth.

    This sums up my argument and puts it to words that I couldn’t have. America is different because the people it’s comprised of are the ones that guarantee the security and freedoms of the free.

    As gun owners our voice needs to explode in volume. We aren’t the criminals here and once the 2A is gone. The 8th will follow and then the 1st. We hold the power for now but by being complacent and weak and mostly silent we lose everything this country was built upon, which made us the greatest country in the world. We beat the worlds largest superpower and then became the largest superpower, within the course of a century (which was never done before). That wasn’t by happenstance, it was because our founding fathers wanted to make a different country from the rest and build it on the truth of freedoms given by God and no other man. We gave up on God, we gave up on our country, and we gave up on our future.

    Go back and read the Declaration of Independence and the Bill of Rights. You will discover that the Second Amendment is far greater than any one mass shooting, as terrible as those have been. The Second Amendment helps us protect our individual rights as defined by the Declaration of Independence. The Declaration of Dependence admonishes us to alter or abolish any form of government that does not support our individual rights. The Second Amendments provides us with the tools to protect ourselves in doing that in case the process becomes violent. That is why the socialist progressive left wants your guns. That is the only reason. Everything else they tout is simply an excuse. We are the only country in the world, to my knowledge, whose founding documents guarantee the right of an armed society. It is the guarantee of our individual rights. That freedom, our individual rights to pursue life, liberty and happiness, is what has made us the greatest country in the world. I think I am not overstating the fact that the Second Amendment is the corner stone of our democracy.

    My response is usually this, when the constitution was drafted they had cutting edge, high tech rifles just like the brits, Washington was in the middle of fighting off dozens of militias, and wrote the 2A anyway without specifying what "arms" we should have. And if that fails I tell them we should just make murder illegal, then nobody would be killed with anything, that's way better than just going after guns. Or if guns are the cause why don't we throw them in prison for killing people instead of who used it.

    This opinion ignores the plain reading of the SCOTUS decision in District of Columbia v. Heller which held that the Second Amendment protects weapons "in common use." This decision by the Federal 4th Circuit Court of Appeals is limited to Maryland as it adjudicated a ban there, but, it could extend to other States within its jurisdiction, e.g., Virginia, South Carolina, and W. Virginia. What's more troubling than one liberal Federal Circuit failing to support the Constitution is the fact that the SCOTUS denied certiorari to review this bad decision. Yet, District of Columbia v. Heller is still the law regardless of what a lower appellate court decides.
