Upper is sitting in the safe just ordered my 11" vtac rail. Need to find a lower so I can finally fill out all this paper work. not looking forward to the 6month wait though...

Be careful with a short upper and a lower sitting in the same place without a tax stamp. I'd highly advise against it.

Regardless of weather its stripped or not, if you have all of the parts to build the weapon, you could be hit with "constructive intent".

Build the lower like I did and put a pistol buffer tube on it and shoot it as a pistol until your paperwork comes back.

I'd be willing to bet that the ATF wouldn't care about that. If there were other AR's in the safe, that might be a different story.

This is by far the most common way of doing it. Nobody likes to let their stuff just sit for 6 months while waiting on a piece of paper.

Do it. It will keep you in the clear while you play with your stuff and wait on the stamp.
