Yeah. There was no legitimate fear of imminent physical harm or death. Unless their law is worded different than what is given there.

Either way... play stupid games, win stupid prizes.

While it is highly suspect, I feel like if the PD didn't press charges, especially after the GZ debacle, there has to be more to this story. At 5 o'clock in the morning and in a high stress situation like that, it is easy to mistake a something in your hand for a gun.

Remember a few years ago, a guy shot a miscreant
breaking into his van from his second floor apartment balcony?
It was either Metairie or the West Bank. He was charged, but got off.

MS changed the law around 4 or 5 years ago for the castle doctrine. You can pretty much just say you were in fear of your life and that is all you need. Pretty loose gun laws up there.

As I understand the MS castle doctrine, it says you can use reasonable force to protect your life OR property. You don't have to be in fear for your life, just that your property is in jeopardy.

Here's the thing. If you leave a gun in your vehicle, surprise a burglar inside your vehicle, there is a good chance that this person is now armed with YOUR gun.

I can see this possibly being a justifiable shooting in a situation like this.

The NRA and other gun rights organizations are getting what they want right now; more headlines about legal and justified use of force with firearms to defend victims.

However this may backfire when so many people against such principles find out just how much it takes to justify homicide with current law, in many states.

Well....shucks. Sounds like the guy picked the wrong profession. Someone somewhere learns that every day, I guess. :dunno:

    Forgive me if I don't shed a tear. Which I won't.
