    BLUF: I love all my Bayoushooter brothers and sisters, but I'd like to hear from LEOs or people with first hand experience. For reasons I will not disclose in a open forum setting, I need to be legit on how this is handled. I'll try to keep this short as possible.

    My kids ride the school bus (5 & 7 yrs old). The bus stop is approx 1/8 mile from our house on the main road. We are outside city limits "in the country."

    300 yards from the bus stop my neighbor has an aggressive pit bull that keeps getting off the chain/out of it kennel and charging my kids and wife.

    The dog had been displaying aggressive behavior (snapping, snarling, charging, chasing etc), so I told my wife to take our two Huskies with her to the bus stop from now on.

    I had spoke to my neighbor several times, even bought him a heavy duty metal clip for his dogs collar. I have nothing against pit bulls, I know the owner is to blame. There is no fence on his property.

    Physical contact was made one day when the pit bull broke loose from it's "tied wire improvised" chain and tried to attack my 120 pound wife as she walked to the bus stop. Our husky jumped in between the pit bull and my wife taking the full bite. The dogs went at it, but because our huskies fur is so thick the pit bull did not draw blood.

    My wife called me and I told her to get the kids and go to a neighbors house until I get there. I called the local police department. A LEO showed up and did a good job at calming me down I was pissed (raced there from work). I told him about the dog, I told him about our dog, I told him about the history. He noted there was no blood and our dog was alright (minus all the clumps of hair in the street).

    I asked what could be done about this aggressive dog. He stated nothing until someone has been bitten.. I lost my temper and yelled at the officer "do you mean to tell me that until one of my kids or wife gets there throat ripped out by the _____ dog we can't do anything? Long story short we chatted a little more and he offered to load my wife and kids in the patrol car and drive them to the house. I was on a motorcycle.

    He ended up calling animal control. Given the situation and local laws he did a good job and I thank him for showing up that day. When animal control showed up the individual said this person has a past of animals being taken away. He stated the individual is in and out of jail. He gave me some good advise regarding my right to defend myself once the dog steps into the street etc etc.

    Then, my neighbor goes to jail (unrelated reasons) dog goes away for a while. Neighbor gets back, dog comes back pregnant. Dog stays in house, then neighbor builds a 10x10 kennel outside instead of the 2x5 he had her in for a year.

    Friday, the dog breaks free from it pin and takes off after my 7 year old daughter who was ridding her bike back from the bus stop after I picked them up. I take off (didn't even know the dog was in the pin) in a full sprint and cut the dog off (It is afraid of males, especially when they grab a fallen tree branch and swing it at them). The dog ran back into its yard tale tucked snarling and barking at me showing teeth. The dog was about two feet from biting my little girl. I was furious, went home grabbed my shotgun and started out the door to my neighbors house. Before I left the yard I had calmed down and pondered over what my options were. Today the dog did not breech its cage, but it is a gamble (you just never know).

    Things to consider:

    I am Military and very well trained to handle this situation, but need to be %100 legal.

    The dog is not afraid of my wife, what is going to happen when I am not there?

    My kids/wife/myself are exposed to this dog 10 times a week to and from the bus stop.

    Everyday we wonder will the dog break free and attack us today.

    I have been around dog animals my whole life, this dog is dangerous!

    I am very confident in my ability to send this dog to a better place, my wife not so much.

    Questions:

    Do I need to wait until my wife or children get attacked to have Law Enforcement step in?

    I will be open carrying everyday to protect my kids at the bus stop.

    1) Is it legal (bus stop and all)

    2) Because of the crazy world we live in, is it ok to (temporally) put a jacket over the firearm so the kids on the bus can't see it when they pull up across the street?

    I told the bus driver that I plan to have protection from now on and she supports me 100%

    I am at my whits end, I don't have my Conceal Carry yet, only option is Open Carry. I understand the legalities that limit our LEOs, but this dog is going to get one of my kids or wife, it's like Russian rulet. My female neighbor is afraid to take walks. I am afraid to let my kids ride bikes out front. And 10 times a week we wonder if this will be the day the dog attacks the kids.

    The dogs owner apologises and tells me he'll kill the dog if it ever bites the kids. I tell him it is too late at that point! He does not have the skills needed to safely secure this aggressive dangerous dog.

    I am fed up and ask for your advice, arming yourself to pick up the kids from the bus stop is not the answer, but I need to protect my children.

    § 102.14. Unlawful ownership of dangerous dog

    A. For the purposes of this Section "dangerous dog" means:

    (1) Any dog which when unprovoked, on two separate occasions within the prior thirty-six-month period, engages in any behavior that requires a defensive action by any person to prevent bodily injury when the person and the dog are off the property of the owner of the dog; or

    (2) Any dog which, when unprovoked, bites a person causing an injury; or

    (3) Any dog which, when unprovoked, on two separate occasions within the prior thirty-six-month period, has killed, seriously bitten, inflicted injury, or otherwise caused injury to a domestic animal off the property of the owner of the dog.

    B. It is unlawful for any person to own a dangerous dog without properly restraining or confining the dog.

    C. A dangerous dog, while on the owner's property, shall, at all times, be kept indoors, or in a secure enclosure. A dangerous dog may be off the owner's property only if it is restrained by a leash which prevents its escape or access to other persons.

    D. The owner of a dog determined by the court to be dangerous shall post signs around the secure enclosure no more than thirty feet apart and at each normal point of ingress and egress. The signs shall bear the words "Beware of Dog", or "Dangerous Dog" in letters at least three and one-half inches high and shall be so placed as to be readily visible to any person approaching the secure enclosure.

    E. If the dog in question dies, or is sold, transferred, or permanently removed from the municipality or parish where the owner resides, the owner of a dangerous dog shall notify the animal control agency of the changed condition and new location of the dog in writing within two days.

    F. Whoever violates the provisions of this Section shall be fined not more than three hundred dollars.

    G. The provisions of this Section shall not apply to:

    (1) Any dog which is owned, or the service of which is employed, by any state or local law enforcement agency for the principal purpose of aiding in the detection of criminal activity, enforcement of laws, or apprehension of offenders.

    (2) Any dog trained in accordance with the standards of a national or regional search and rescue association to respond to instructions from its handler in the search and rescue of lost or missing individuals and which dog, together with its handler, is prepared to render search and rescue services at the request of law enforcement.

    First thing I would do is try to get the bus stop moved. Talk to the bus driver and ask who you should talk to. Be sure to get your request on record. This is not a total solution, but it might help some.

    Hey bro, I can help you. My family runs Swampy Paws Canine Rescue and the Livingston Parish Humane Society. I'm also an LEO.

    As far as the law goes, there's nothing anyone can do until a law has been broken. Also, a dog can't assault you, so charging you without contact isn't a crime. (However, you're still justified to shoot the damn thing if it excites a reasonable person's fear of attack).

    If its being neglected call the Humane society and they'll investigate cruelty, but I suspect not. It's just an idiot owner that has ruined a dog.

    As for carrying (I'm also a CHP instructor), throwing your jacket over your handgun and concealing it from the general public would be a crime. Also, carrying your handgun within 1,000ft of school property or functions (IF you have business with the school, which escorting your kids to the bus certainly applies) its not legal. If you had No business with the school, that law wouldn't apply IIRC. However, you gotta keep your kids safe man, I cannot see an LEO not using his discretion here. I almost certainly would.

    I am not a LEO, but I don't see how it could be illegal if you shoot it if you feel threatened for yourself or for your family.

    Does your wife carry pepper spray/mace with her? My mother works for the post office and has had to use it on crazy dogs. Have you reported to the humane society that the owner has intentions of killing the dog himself should it bite someone?

    I had a similar situation with a neighbors pitbull. Had one get off the leash one morning and came after me (glad it wasnt wife or kids). I got into my fenced yard quick enough, but that was almost the last day of that dogs life. He was almost shot (another reason I NEVER step foot out my house without a gun). The next week, another one of the same neighbors pits got loose. This time it was when Houma P.D. just happened to have someone pulled over in front of my house for a traffic violation. The dog came after the officer. A couple well placed shots from the officer, and no more dog problems. ...............I would be very cautious about guns at a bus stop. Even if you need it to save a childs life, there will be some pansy that will have a problem with it.

    Call animal control EVERY time the dog is out. Be that guy!!
