    House Bill 195

    broadly defines a secondhand dealer to include “… Anyone, other than a non-profit entity, who buys, sells, trades in or otherwise acquires or disposes of junk or used or secondhand property more frequently than once per month from any other person, other than a non-profit entity, shall be deemed as being in the business of a secondhand dealer.

    The law goes further to require secondhand dealers to turn over a valuable business asset, namely, their business’ proprietary client information. For every transaction a secondhand dealer must obtain the seller’s personal information such as their name, address, driver’s license number and the license plate number of the vehicle in which the goods were delivered. They must also make a detailed description of the item(s) purchased and submit this with the personal identification information of every transaction to the local policing authorities through electronic daily reports.

    That would make sense but wouldn't be easier to just make the scrap metal buyers do this and not blanket everyone into it? As it reads now, if you sell more than two guns a month then you are required to collect this information about whom you sold to.

    Totally against it. Stealing copper is already illegal. We don't need to make it "more illegal". This law is total ********. Next thing you know, they will want want you to send them a copy of your monthly expenditures net gain/loss item by item--to catch terrorists and thieves of course!

    Less regulation, not more.

    For you extreme scrappers out there, aluminum cans are excluded. That is the only item that cash is paid out on at the scrapyards now. They gather no more info than they did before when selling at the scrapyard but pay by check now. No 1099 forms or tax info gathered. A thief can use another person's ID to sell at the scrapyard and get cash but now he will have to pull this off twice to cash a check at the bank. I don't know how this works at the pawn shop as I have not been to one in a while. I don't like nanny state policies either but our elected officials see it otherwise.

    Agree with you. Americans are being so "over regulated" that the stress is killing us.

    Death certificates should list "over regulation" as a cause of death in some cases now.

    Unless you have a garage sale more than once a month I think you're excluded.
