Not that my opinion counts, but I would err on the side of caution and not risk the interpretation. If you want to carry open, then carry open with a holster on your belt, leg, or somewhere else completely in the open. Make sure that the weapon is always completely visible (e.g., shirt tucked, no jacket covering, etc.).
Like others have said, why take the risk that a police officer, judge, and/or jury would interpret in your favor.
Better yet, just get a CHP and don't have to worry with it.
