    HONOLULU (AP) — Nicole Leszczynski couldn't imagine that two chicken salad sandwiches would land her and her husband in jail and her 2-year-old daughter in state custody. But it happened five days ago, when the 30-weeks-pregnant woman forgot to pay for her snack while grocery shopping.

    "It was the most ridiculous chain of events that happened," she said while sobbing Monday. "It's still hard to believe what happened."

    Leszczynski, 28, and her husband Marcin, 33, were handcuffed, searched then released on $50 bail each. Their ordeal at the police station lasted a few hours, but their daughter Zofia spent the night away from her parents in a case that has sparked nationwide outrage and forced the Safeway supermarket chain to review the incident.

    The family had moved to an apartment near downtown Honolulu from California two weeks ago. Still settling in, they ventured out Wednesday to stock up on groceries, took the bus, got lost, and ended up at a Safeway supermarket.

    Famished, the former Air Force staff sergeant picked up the two sandwiches that together cost $5. She openly munched on one while they shopped, saving the wrapper to be scanned at the register later.

    But they forgot to pay for the sandwiches as they checked out with about $50 worth of groceries.

    "When the security guard questioned us, I was really embarrassed, I was horrified," she said. They were led upstairs, where the couple expected to get a lecture, pay for the sandwiches, and be allowed on their way.

    But store managers wouldn't allow them to pay for the sandwiches, she said.

    "I asked to talk to a manager and he said it was against their policy to pay for items that left the store," she said. "The security guard said we were being charged with shoplifting."

    Four hours later, a police officer arrived and read them their rights. A woman from the state Child Welfare Services arrived to take Zofia away.

    The pregnant mother said she tried to keep her composure until Zofia, who turns 3 in December, left the store. "I didn't want Zofia to be scared because she's never spent a night away from us. She didn't have her stuffed animal. She didn't have her toothbrush."

    But as soon as her daughter left, "I got completely hysterical. I went to the bathroom and I threw up," she recalled.

    A Honolulu police spokeswoman said it was procedure to call Child Welfare Services if a child is present when both parents are arrested. The store's management did not know the girl would be taken away, said Susan Houghton, a spokeswoman for California-based Safeway Inc.

    The national supermarket chain said it was looking into the incident. "It was never our intent to separate a mother from her child. That was a very unfortunate consequence to this situation," Houghton said. "We understand the outrage. We are concerned about how this was handled."

    Leszczynski called the incident "so horrifying, it seemed to escalate and no one could say, 'this is too much.'"

    The couple was handcuffed and driven separately to police headquarters a few blocks away, where they were searched, had their mug shots taken and then released after paying bail. A police officer escorted them back to the store — which banned them for a year, Leszczynski said — where they picked up their groceries and walked home just before midnight.

    "We basically stared at each other all night. We woke up at the crack of dawn and called (the state child welfare office)," Leszczynski said. While they waited, Leszczynski vented about the experience on babycenter.com and contacted a lawyer for help with being reunited with Zofia. At the lawyer's suggestion, they took their story to the media.

    Zofia was returned after an 18-hour separation from her parents.

    The couple is charged with fourth-degree theft, a petty misdemeanor, and has a court date on Nov. 28, according to the city prosecutor's office. The family hasn't decided whether it will pursue legal action against Safeway.

    Houghton said the company will review the police report and store security footage before deciding whether to press charges.

    I would be pissed if that happened to my kid, but I really hate seeing people walking around the store stuffing their face. I don't know why, but it just drives me crazy. I don't care how "famished" she was, if they only bought $50 worth of groceries, then that didn't take long. You won't starve.

    Everybody who is shoplifting says they "forgot to pay" for stuff. In this case though, $5 is pretty rediculous.
    Most chains have a minimum price for prosecution, anything under that as long as the person isn't a repeat offender, is cooperative and either gives the item back or pays for it they leave with either a warning or being banned from the store.

    Why didn't they just set a $20 on the desk and walk out?

    If the cops were called.... "Yep, I paid for it"

    I'll sometimes leave the $ on the table at an oriental buffet I like rather than checking out...

    I dont eat my groceries till I get home also !!!! 5$ and all that B.S.and they wouldnt let them pay for the sandwiches,isnt like they tried to run for the door with the loot !!! Seems like there will be an Ex-Safeway manager and a lawsuit !!!!!

    To me there's a big difference between eating a sandwich, saving the wrapper and forgetting to pay for it, and blatantly stuffing things in your pants to steal them. Hell, I've walked out forgetting to pay for stuff on the bottom rack of the cart, and I've had my kid grab stuff without me noticing. I've always gone back and paid, but if they put me in jail and took away my kid we'd have BIG problems. And I'm not a fan of people eating in stores, but I also know good and well not to let a pregnant woman get hungry. Scary ****. To me it sounds like an overzealous security guard on a power trip.

Hell, I've walked out forgetting to pay for stuff on the bottom rack of the cart, and I've had my kid grab stuff without me noticing.     Speeds right on the money as I see it. If shes hungry let her eat and pay on the way out. Yea they slipped up, slap em on the wrist and let them go. This is excessive and barring and previous record smells a lot like a lawsuit.

    I only shoplifted once... at Woolworths in the 8th grade. And only because I really wanted that Hershey bar, but couldn't find anyone to take my money. I still regret it.

    A few things come to mind:

    At least they didn't try to put her fetus in overnight custody too.
    If they were "famished" then they would have gotten a quick bite, eaten, then went back to in purchase
    I'm assuming they were able to return the $50 in groceries for a full refund?

    The manager is a dick head. If it was just one person that ate the sammich and bought groceries, that's bad enough and I'd say he/she deserves to be punched in the face at random in the next 5 years, paid for by the person that was arrested.
    That they had a couple arrested, who had a kid with them, wow.

    I hope someone punches their kids in the face.

    Oh and as far as eating food before I buy it, I did it when I was a kid and it annoyed my mom. As an adult I don't do it it because it slows me down from GTFO out of the grocery store, which is my main objective.

    However IF I go to Wal mart, I will usually eat at Subway while I'm there, and I have been known to walk 20 feet and get a chocolate milk to go with my meal. I pay for it when I get up front.

    Sounds pretty ridiculous to me. I had a college roommate that never bought food. Just walked around Wal-Mart eating. These people at least were probably going to pay for it had it not allegedly slipped their minds. Easy to do I guess in that situation. I don't think the crime warranted the punishment.

    It was stupid for them to eat the stuff while shopping. I think that in itself is illegal. However, I think that the store did not act reasonable at all and I think some sort of legal retribution on behalf of the couple is warranted.

    I think they just forgot, it would be easy to do. Especially if safeway is like brookshires or superone where they empty the buggy for you, the cashier would think it was trash and if you weren't paying attention you may not remember to say anything. Im just curious how did they stock up on groceries for $50.

    I have got aggrevatrd before and just threw about what I would owe on the counter and walked out because someone was not there or taking way to long, usually on small items like that that only cost $1-$2

    Thank God they reacted quickly and nobody was injured in the apprehension.....
