I'd say same as a purse or fanny pack, so yes. Now a tackle box sitting on the ground I'm not so sure about since you're not wearing it.

Even since it is in a see through compartment? I would bet that more of the pistol would be concealed in a holster OCing than in the mesh. And yes it would be sitting on the dock or boat not on my person.

No, it's not concealed as long as it is visible that it is a weapon and you have no intent on concealing.

If it is in a mesh see-through compartment you are obviously not trying to conceal.

I was wondering the same thing if it was an extension of the home.

I don't know for a fact but I do not think that it is the case. Last I remember, which may be incorrect, you're not even allowed to carry certain guns on a boat....anything more than a .22lr? Maybe that's just charter boats, maybe I'm totally flawed in my memory.

never heard of anything even close..... in fact there is a lot of people with water access only hunting camps carrying deer rifles, duck hunters carrying shot guns, etc. you just can't hunt from a moving vehicle. Oh, and also a pistol seems to be the preferred method of putting down an alligator after he's caught and dragged to the side of the boat.

Thats true, I got a lot of that from a safety thing on a boat but it was an old boat and maybe it was suggestions & not law. lol

Hopefully someone will post the actual legalities so we can be properly educated.

    guns in boats

One time I was pulled over by the Coast Guard on the Diversion Canal. Asked me if I had a gun in the boat, along with the usual other questions. I told them yes and do you want to see it. He marked it down on the boarding slip and said, no, just leave it where it is. Another time I was shot at by the boat launch in the Intracoastal Waterway in Port Allen, had to return fire. Called the police and told them the story, he asked what kind of gun I had. I told him and asked him if he wanted to see it, he said no.

Doesn't appear to be an issue.

I don't know what the law states.

    ????????
    I guess you want more?

We used to ski in the Intracoastal and one day this bro in a jet boat pulls up as we are launching and tells us that we have to move so he can take his boat out. Well, long story short, my buddy and him have words, throw a couple of punches and we launch so my buddy is in the boat and he is on shore. I park the truck and while walking back, he tells me. I got somethin for you too! We go ski for a couple of hours and when we get back, he is there with some other crackhead and basically takes some shots at us. I return fire, he runs and we call the cops.

Before we left one of my buddies asks why I take the gun and said something like "If there was a combat type situation, you wouldn't know what to do anyway". I reminded him of that on the way home.

    Don't leave home without it.

what gun you used??? imo i need a hand gun and a rifle in the boat at all times.

anyway i also think the boat falls under "extension of the home". i was checked by several game wardens over the years and they all saw my handgun in my dry box and said nothing at all.

    Concealed or Not?

Here is some applicable state Supreme Court decision on the factors determining concealment.

State v Fluker/Westlaw 311,So.,2nd 863 (1975)."If the weapon is carried in a manner which reveals it's identity,it's carrier cannot be presumed to have intended to conceal it and, accordingly does not violate statute proscribing INTENTIONAL concealment of firearm on one's person".

"Weapon, although not in full, open view, is nonetheless not "concealed" if it is sufficiently exposed to reveal it's identity".

This decision is the one which fits your question best I would think.

I'll keep a rifle on board with a low powered scope when I get a boat. I remember the problems back in the '80's between the commercial fisherman and the Vietnamese. Shots were fired between the two fairly often (few hits though) down in lower St. Bernard.
Occasionally sporting fisherman would get either mistakenly shot at or caught in the crossfire...
